Aloha mai kākou,

We want to bring everyone up to speed since our last email. As a recap, Mayor Rothʻs request to dismiss our suit was denied by Judge Kubota. While we feel that our case is strong, we requested that the County enter into mediation with us. MaKa is pleased to announce that the Mayor has agreed to our request for mediation. Our goal in this process is first and foremost to restore ocean access for Hawaiʻi residents, while also addressing some of the real issues facing Waipiʻo Valley. These issues include over-tourism, general carrying capacity, and increased support for Education Officers.

These are complex issues that will take time to resolve, and so we are proposing that there be two phases to implementing changes. The first phase would immediately restore access to Island residents, with important vehicle and pedestrian safety controls, while the second stage would focus on solutions to the above issues. We believe if the county and the community are able to join forces and collaborate, a healthier Waipiʻo will be the result for future generations to enjoy.

Mediation is scheduled for mid-August, and due to this the hearing on our motions has been rescheduled to August 30th. We are extremely grateful to our attorney Steven Strauss, who has been guiding this process with a steady hand on a purely donation basis.
